DNA Paternity testing can help determine paternity if there is ever a question. Sometimes alleged fathers want to know for certain if the children they are raising are truly their biological children. DNA testing has been around for many years, and the scientific breakthrough is astonishing. It is amazing what the DNA testing world can do: not just in paternity testing, but in forensics as well.
Paternity Testing on Identical Twins
A paternity test can answer questions about paternity, but there is one situation where mainstream DNA paternity testing may not give answers. What if the two alleged fathers are identical twins? Identical twins share identical DNA, so a DNA test cannot identify which of the twins is truly the biological father of a child.
DNA Testing Story
This is a real-life scenario for Holly Marie Adams. Freepublic.com presents Holly’s battle with Raymon and Richard Miller. One of the brothers is the biological father of Holly’s 3-year-old daughter, and one is the uncle. But which is which? Raymon and Richard are identical twins, who both had sexual relations with the child’s mother at the time of conception. The DNA testing that was completed indicated that both twins have a 99.9% chance of being the biological father: again, because they have identical DNA.
With both twins denying paternity of the child (neither wants to pay child support), how would you rule if you were the judge overseeing this paternity test case? Because Raymon was originally listed as the father in the paternity suit, Judge Fred Copeland ruled that he will remain listed as the biological father and will be held responsible for child support.
Paternity Test did not prove Paternity
Raymon believes the state should pay for the child and he should not be responsible because paternity could not be proven, even with DNA testing. Holly Marie Adams just wants the battle to be over.
The final appellate court did make the decision that Raymon will remain the legal father, although he claims that his brother is the true biological father and doesn’t want to take on the financial liability. Holly claims that she can pinpoint the date of conception and it all points to Raymon being the biological father of her daughter.

What an interesting story. I wonder how often this happens?
it seems to me like the fair thing would be to have the brothers share the financial responsibility. But I suppose our justice system isn’t really set up to handle that kind of thing.
Krystina Jones says
That is exactly what i was thinking. They can split child support and responsibilities.
Jose says
But one of them didnt father the child so it would be unfair
Aj says
This happened in my situation. My father had a twin that committed suicide, so that further complicated things. But because the dna was inconclusive, there was no way of proving my father was actually my father. It’s a messed up, shitty situation.
Isley says
They should NOT split the financial responsability, that wouldn’t be fair for one of them. This is not about finding someone who pays for the girl, this is about Why do one of them have to pay for the other’s mess. This girl should be supported by the state, because is the state who can’t prove or deny the paternity of them.
laura says
Yes they should. It was proven they both could be the father. They both deny responsibility. One needs to step up or they both support the child. That should be their choice. If I was the judge that would be my ruling. One of you takes responsibility, or you both support the child.
Angie says
Why should the state have to pay? They are not responsible for the birth of the child. They can’t conclude who the father is because there isn’t a test to determine that between identical twins, not because the state is doing something wrong. I’m sorry, but that was kind of ridiculous. The state should NEVER have to pay instead of the father. EVER.
I actually agree with what the state has decided. It is the only method available that gives them a somewhat accurate idea of who the father is, along as they’re also looking at ultrasound records and such as well, not just her word. I feel for the child though. Both of these men should be ashamed of themselves. They both have a chance of being this child’s father and instead of stepping up and being there for the baby, they’re fighting over who is not the father. A decent human being, a real man, would be fighting over who IS. They would want to take care of the baby, even if they didn’t want to be a dad at first. Because that is what real men do. They take care of their children, the mothers of their children and they know that there are consequences to every decision in life and they face those with honor.
Cheryl says
Why should the tax payers support the child? The tax payers didn’t sleep with this woman and get her pregnant, the problem is that all three of them are irresponsible. The state may not be able to determine which one is the biological father but thats not the stated fault. To tell the truth if the biological father can’t be determined them the mother should have to have full custody and full financial responsibility, thats how other mothers who don’t know who the father is have to handle it. Yes the men are getting off scott free in this issue but maybe she should have thought about that before she slept with both of them.
Rlamay says
My father is going though the same thing and has been for the past 16 years. The woman was Seeing my uncle which is my dads identical twins. He denys the child even though the woman and my uncle were in a relationship and living together. My father has a child with this woman prior also. Is there any test that has come out since this that may help. This woman has put my father through hell and my uncle refuses to take responsibility! I think that since she decided to lay down with two twins and the state cant prove which is the father… She should pay for her own child.
Amber says
Hi Rlamay,
If your father and uncle are truely Identical twins, then there is no way to determin which one fathered the child. The test can only exclude both of them if there was another alleged father. When it comes to child support its really up to your own state laws to determine what to do in that situation. The law will look out for the best interest of the child. If the paternity test does not exclude them, SOME states will go based on conception dates and who was with her at that time. I would recommend contacting an attorney in your area to determine what your father’s rights are and what the law indicates in this situation.
Mike Crichton says
Isley, it’s only in the last 15 years or so that DNA testing has even been available for paternity tests. Prior to that, they were decided the same way this case was: preponderance of evidence. This is a civil case, not criminal, and the standards of proof are lower. In any case, the interests of the child are more important than those of these two irresponsible idiots.

I have a question. I am an identical twin. My twin passed away suddenly 2 years ago. She had a 3 year old and a one week old baby upon death. We (my family and sister raised the girls in my family home) were completely awe struck when the father took my twins children in the middle of the night 3 states away. My family has not seen them in 20 months. Now Genetically and biologically I am the childrens mother as my twin and I share the exact DNA. So why do I have no rights to these children? They are as related to me as their father and he took them from their lives and against my twins wishes before death. So how can I get my rights heard?? She is half of me and this is insane, he is a bad person and I need to be with the kids, what do I do??
Amber says
Hi Aloe,
I am very sorry about your situation, and I really wish I had answers for you. However, because every state is different when it comes to family law your best option is to contact a family law attorney in your area who can answer these questions for you. As an identical twin you do have the exact same DNA as your twin, however, I am not sure if that holds any standing in the law. An attorney can review your case and assist you with what your plan of action should be.
sara says
it doesnt matter who has the same dna, it is who is on the birth certificate. since the mother passed away.. all rights go with the father if he was on bc. now you can always try to fight it, but you have to do it the legal way. but why would a judge take away a child from their father “just” because?

Im currently 5 months pregnant with a child and have been in relations with two brother’s that are identical twins. I am not going to be claiming any form of child support. One of the brother’s just thinks its his, and the other brother knows that it could be his aswell. This second brother know’s its either of them. But the 1st brother dosn’t know that ive been in relation’s with his brother. Im just going to let it be. If anything happens to me. Atleast the 2nd twin is knowing the whole story. At the end of the day I know both brother’s wont be in the childs life eitherway as they both have their own family’s already and Im not wanting to create any issues. Just want to have my baby with no drama. Call me anything you want. Nobody is perfect. So don’t judge. As for the above story it would be great if both brother’s just saw the girl as family regardless if they are uncle or brother and wanted to give in anyway possible just to help with her upbringing as they are family regardless. But thats wishful thinking!!

Tam,
Thank you for sharing your story with us. Are you sure that the two brothers are identical? Have they ever been tested? If they weren’t identical and determined fraternal, you could test and prove paternity. We are sorry for the pain you are going through. We wish you and your child the best in life. As a company, our focus is on providing paternity answers so that each child has a chance at knowing their biological father. There are many reasons that go along with knowing paternity. We hope you can somehow resolve this issue. If we can help, please let us know. We do offer twin testing.

Why not split the responsibility 50/50??? They both took the same risk, it’s really down to chance who fathered the child. Potentially it’s either of them, the both took the same risk !

WHY DONT PEOPLE JUST NOT HAVE SEX UNTIL THEY ARE MARRIED? SHE SLEPT WITH TWO GUYS SHE WASNT RESPONCIBLE AND NOW SOMEONE ELSE NEEDS TO PAY CHILD SUPPORT?!?!?! WE KNOW FOR A FACT ITS HER BABY SHE CAN PAY FOR WHATEVER NEED THAT BABY NEEDS, DO STUPID THINGS OWN UP TO IT AND NOT BLAME THE BROTHERS. YOU HAD UNPROTECTED SEX LIVE UP TO YOUR MISTAKES.
Keri says
I’m thinking this is what they all get. Her for sleeping with not just brothers but identical twin brothers & them for sleeping with the same girl. The only one that suffers in this situation is the child, she will spend the rest of her life not knowing who her real father is but knowing neither one of these “men” want to take responsibility.

I have the same problem , I was with a my boyfriend he is a twin , he changed my life , he has a twin I never really as interest in him . I found out my boyfriend was cheating on me with his ex. because his twin brother told me when we where just hanging out , that day I was so upset I had asked him again and again and he would tell me the same that he was cheating on me he hugged me and comforted me. And that led to other things. As we ended up sleeping with each other I don’t know why I did it or what triggered me to do it. Honestly I felt so betrayed , but I shouldn’t of done it .. I remember I regretted the next day. My boyfriend asked if I could come over and I did but I was so disgusted of what I had done I didn’t even mention of him cheating because I had cheated . 2 months later I find out I’m pregnant. But I was only 5 weeks pregnant so there was no way that it could be his brothers. I had told my friend what had happened, month later she tells my bf what I’ve done .. and he swears its not his child and its his brothers. I know it’s his I could prove it but he never wants to talk to me again. His whole family loved me and now all hates me. I don’t know how to even talk to him or confront him, he is really mad and upset at me. Me and his brother both know its his but he denies it. That’s my story I’m still 3 months pregnant . Any suggestions, I was thinking about doing this on my own , and letting things be and not even bother with child support. I will still put the last name of the father.

Hi Mia,
Thank you for you patience! We understand paternity questions can have life changing results, and we are more than happy to assist you in finding that peace of mind and resolution. If I may ask, are the brothers fraternal or identical twins? When there are brothers that are related, we ask that both of them participate in testing. Not doing so could result in a false positive. Before sending in your samples, we would recommend that you advise us of your situation. When there are two potential fathers that are related, it is important that our lab is informed in advance, especially being twins. Just today, on a paternity court case on TV, this exact scenario took place and came down to the judge ordering lie detector tests. The findings led her to decide which brother would be considered the father and held responsible. I was shocked that a decision like this could be made with these tests results. I always thought lie detector tests were not admissible in court.

I did Dna testing last Thursday and recieved a 99.997 % result that I was the father, and then later today I researched and found out my identical twin and I have the same DNA. My brother slept with her one night, I slept with her the next, and then he did again on the third night. He and I have different blood types, could this be a deciding factor in determining the actual paternal father? Please help!!! Lost

Hi DI,
Thank you for your patience! Did you inform our lab your identical twin is a potential father as well? We would highly recommend to have you both tested and let our lab know of your identical relation. It would also be crucial to have the biological mother included in testing as well. This will help in determining the relationship of the child. It would be best to call us so we may better assist you and discuss the options in detail about your case. I hope this information helps.
