When the paternity of a child is in question, the most reliable way to get definitive answers is with a DNA paternity test. But what if you’re not listed as the father on the birth certificate and the mother won’t give permission for the child to be tested? As a mother, what if you suspect a man is the biological father of your child but he refuses to test? All highly-accredited DNA labs require consent from all participants, so doing a ‘secret paternity test’ is committing fraud. What can you do? Here are some possibilities.
Negotiate without Lawyers if Possible: Just Talk
Lawyers are expensive. If you can possibly work things through and come to an agreement without involving the courts, you both stand to save a great deal of money, time, and heartache. Being able to work things out yourselves keeps your relationship as positive as possible, which benefits everyone involved.
Approach the topic calmly: Even if you aren’t together anymore and things didn’t end well, ask to talk, and then be as even-keeled and friendly as you can during the discussion. Losing your temper will just make your former partner dig in their heels further-promise.
Get their side of the story: Find out why she doesn’t want to agree to testing or want to sign permission for the child. Find out why he doesn’t want to test. If you determine the reasons behind the refusal, you can figure out how to best convince them it’s the right thing to do.
Give your own reasons for wanting the test: If you believe you are the biological father, explain how a relationship with the child will be beneficial to them financially, legally, and-most importantly-emotionally. This same argument holds true if you are the mother wanting to convince the possible father to agree to a paternity test. If there is a possibility the child is not your former partner’s, it’s important to point out that the child has a right to form a relationship with their biological father and to know their family heritage and medical history.
Talk about what happens after the test: Often, a former partner is reluctant to agree to a paternity test due to the possible consequences of the results. Will they lose child support? Will there have to be changes made to custody arrangements? Honestly talk through what you both see happening once you have results-whether the test shows a biological relationship or not. This takes a major elephant out of the room.
Remember to stay calm during all discussions. The future of a child is at stake, and they are relying on the grown-ups in their life to make civil decisions on their behalf.
Try to Get a Court-Ordered Paternity Test
Unfortunately, sometimes talks can break down no matter how hard you try. A parent can refuse initially to take a paternity test, but a court can (and often does) compel them to take one anyway. You should first try doing everything you can to prevent having to go to court, because the process often creates long-lasting tension between a former couple. Remember, if results show the possible father is the biological father, you’ll be linked for life.
Find out what your parental rights are where you live: Laws definitely vary from state to state, so it’s important to get legal help in determining what your options are and how to proceed.
Court-ordered testing: If the court determines that a test is required, it will be a legal paternity test. The only difference between a legal test and a peace-of-mind test you do at home is that the identification of participants, DNA sample collections, and sample mailing are all witnessed by a third-party impartial person. This ensures that everyone is who they say they are for the test, and that no fraud can occur. But the actual testing process at the lab and the paternity test report are exactly the same.
The Bottom Line
Being denied a paternity test is a stumbling block to determining a biological relationship, but it’s not the end of the road. Every child has a right to know who their father is, and if you and your former partner can’t work things out yourselves, the court is always available as a last recourse. Actually only way to ensure the babies father does not get cusody or visitation is to move to where no one knows you and live out of the system. It is illegal to do this but if you dont get caught then its not illegal. The legal way would be prove to coirt that the father is abusive. No court will let a child go to an abusive home.

If you refuse to comply with the order, then they often assume that you are the biological father and will rule accordingly. Steven K, That is patently false. Depending on the State, they can garnish your wages for child support if you refuse. The laws are slowly changing, but in many states, if residing with a woman for a certain amount of time, you can be on the hook for the child even if you know its not yours.
The only way around it are DNA tests, but that can take months before it even gets to the courts. During that time YOU are on the hook for it. So you could be paying for several months, waiting for the results, before your name is cleared. Oh, and also, once it has been proven that you were never the father, you are NOT reimbursed for the money you did submit.
So yes, you do have the right to remain silent, go ahead. That doesnt bother Tyrone at all, as you are taking care of and paying for his offspring and its on YOU to prove its not yours.

I caution you about relying too much on looks as a determinant of paternity. My girlfriend has been jumping through hoops to get these blood/DNA tests done to prove who the father is. The problem is, she’s done her side of things, (the baby has had his mouth swabbed) but we can’t get the other side, the potential father to do so. He keeps making up excuse as to why he cant. Also if your state is like mine (NC) and you are still ( if you ever had been married to your first sons father I mean, and you were when your second was conceived/delivered) you would have to be legally divorced before anything New/different could be established by test then court ordered by a judge to change or update the current bc. The little one is definitely mine and she has acknowledged it in several forms and I was even at her baby shower my whole family was but after words my whole family was blocked from communicating.
Recently I had received an email of a picture of my daughter the mom and her new boyfriend kissing her on the head. I proceeded to go through the courts for a court ordered paternity test. Would the fact that I had not done this sooner effect me with custody or visitation?

I’m not sure how the mother of the other man could do a paternity test without your knowledge, since she would need unsupervised access with the child in order to get a DNA sample. I don’t know what you mean by “threatening.” They can petition the court for a paternity test, but there’s no guarantee the court would agree. You are in control of this situation, actually. Because you were married at the time the child was born, you are the parent in the eyes of the law.

My friend’s daughter died of a drug overdose 14 months ago. She left behind a 10 month old daughter. A couple is living together. Previously, woman was in an abusive relationship but thinks she might be pregnant with his child not by the current man she is with. There is a test done and she finds out she is pregnant but has a falling out with the current man. She moves to another state. Sends a message stating she is pregnant but not by the latter man. A few months later she contacts the man stating she is pregnant with his child after all.
The man obviously dubious of her word states he can’t trust anything she is saying and is concerned she might be pregnant with his child. Because child deserves to know who the right father is going to be he is unwilling to claim a child that may be another man’s nor is he willing to deny child may be his so he is in limbo. Telling her as much he wants verification of paternity. She continually concedes she lied but won’t submit to a test often going off on hurtful rants against him then blocking him from contacting her even though she contacts him out of the blue randomly.
Man in question does not have any resources to go to her state nor is she willing to come to his. Suggestions on course of action? Is there any way to have paternity test done when people are living in two separate states. Potential father in question lives in Oklahoma and as far as he knows mother resides in California.

For his own protection, once the child is born, under no circumstances should the man agree to sign an acknowledgment of paternity or birth certificate until a paternity test is performed. If he really wants to know the answer for the sake of child (and it sounds like he does) and she will not agree to testing, then the courts may compel her to do so. If she agrees to testing, then being in two different states is no problem. The lab simply sends testing materials directly to both parties. Since the relationship between the two is contentious, I recommend that he insist on a legal paternity test, wherein DNA collection and submission to the lab is supervised by an approved witness. This way, results can be used in court. Results of a home test cannot be used in court. Legal testing costs a little more, but it’s well worth it. Hopefully this has been helpful!

What your saying makes no sense. Because if she was pregnant before y’all got together she would have know how far she was when going to her OB doctor. Also, condoms are not foolproof birth control and statistics show there is a 2% chance for someone to get pregnant, even when using a condom. My daughter passed away a month after having my grandson. No father is listed on birth cert cause the alleged father was in jail at time of birth. My wife and I want custody and to adopt. And so does the great grandmother and grandmother.

My daughter had a beautiful daughter about a year ago and named her Marley. The relationship she had with the father was very short and to cut a long story short he’s denying he’s the father. You see this lad lives in the UK but he’s from Turkey. The mother of the child I suspect is mine has lost primary custody. The child now is lives with the mother of the guy on the birth certificate because his life is somewhat unstable. Now the grandmother barely see him at all. Maybe once every two weeks. The mother don’t want the grandmother to help with the care of her grandson. Don’t want her to buy clothing , shoes or anything. My question. IS it anyway that a DNA test can be perform using the mother of the son that is in prison. to determine that the child is really her sons?

I became good friends with this girl we ended up hooking up one time. About a month or two later she tells me she got pregnant by this guy shes dating. I did ask her if it could be mine she said no it was a month apart. I mention to her how we use to go running together and if she still goes for runs, she replies kinda hard to run being 8 months pregnant? I said I thought u lost the baby? She couldn’t keep up with her own lie. Anyway after I brought it to her attention she blocks me again ignore and no way reaching her. So basically the guy she hooked up with same week we did doesn’t know about me or that it might not be his kid and her new man the same thing she hasn’t told anyone about the possibility of me being the father. Now the babyis born and I ask for a DNA test given she said it could be mine I know for a fact it could be mine because the time she had baby exactly 9 months before is wen we hooked up but now she’s denying there ever was a possibility that she slept with the other guy a month later so her whole story changed. I found some pics of the baby on FB they posted and I believe strongly it looks like me but she won’t has me blocked no way of. Contacting her she won’t give me DNA test to prove if it’s mine or not. My thing is if shes so confident it’s not mine y wont she do the DNA test right? Idk what to do. Before she blocked me she did respond saying she don’t want to because everything is going so great for her with new man and doesn’t want to mess that up. And she shouldn’t be talking to me because she don’t hide things from him. I’m like if that’s the case they would all know about this situation already it’s not my fault u started a relationship with on if the biggest lies. So apart of me says if she ain’t cooperating I’ll contact her man. And fill him in with all this. How do I go about getting a DNA test from her it’s really frustrating that someone can be like this keeping and lying to someone about who the father is I’m not I will not let this go until I get those results that all I want. She’s crazy if she thinks I’m gonna be ok with it and forget the possibility of me being a dad. What do I do?

Hi, Robert. You have two years to contest paternity of a child. Since she’s not cooperating and is unwilling to test, you should contact a family-law attorney to see if she can be compelled to do so by court order.
And also i want to ask if her new man signed the birth certificate lets say I do happen to be the baby’s biological dad given he signed certificate does that automatically mean I’m exed out of my kid’s life because of this evil female that lied to everyone and keeping me from my kid saying it’s not mine? If another man takes legal responsibility of a child by signing the birth certificate, you must go through the court to contest paternity. It’s at the court’s discretion whether or not they would allow you to be part of the child’s life. As I mentioned before, you definitely need an attorney.
I am currently pregnant and my ex boyfriend is now saying he is going to take me to court for a dna test he is an awful person and I have test messages of him threatening me. I have a friend who is legally married to a man she separated from 19 years ago. They just never bothered filing a divorce. They are now doing so. The man she’s been with for the past 15 years is the father to her children. He was named on the birth certificates. The legal husband, which she is now divorcing, acknowledges he is not the father, and is not requesting a paternity test. The biological father of the kids is also not requesting a paternity test. He acknowledges he is the father. Will they still be obligated by Texas law to perform a paternity test?? Neither party is requesting one or challenging this.

Can a man who believes himself the father of a womans child force a paternity test after 8 years. The mother and legal (on BC) father have been together for a very long time but never married. They are still together and a very happy family. I fear that this testing (even coming back negative) would be detrimental on the family and their relationships.
